Law and Justice (Prawo i Sprawiedliwość, PiS)

 As PiS stress, these are issues of great importance that gives a chance for realization of polish national interest. From perspective of the EU rules and procedures, it has been confirmed in the Treaty Lisbon, but it is also necessary to establish respective internal procedures. Not the point is that today or in the foreseeable future use of the possibility of - Law and Justice clearly favors for permanent Polish participation in the EU - but rather to confirm the provisions of the Polish constitutional status and statutory indisputable principle of sovereignty, which implies our right to unilaterally decision to withdraw from the Union.

Analyzing the PiS perception of Poland' role in the EU, the emphasis on the strong role of Polish nation is not surprising. The national pride is understood as an important element of Polish national identity. In addition to this, the party supports strong nation based sense of belonging that will contribute to Polish economy; likewise in Bavaria. PiS stress the role of strong national state in among other is ability to defend the civic rights, equality as well as rights of national minorities. Contrary to previous election manifestos, the current one criticizes the liberal and so called western values with greater extend. The manifesto emphasizes the spirit of Central Europe - common traditions, shared historical experience; therefore the for the future the national state should be the most important category.  

The conservative party was founded in 2001 due to the fragmentation of AWS, the bearer of the revolution ethos. PiS started to unify the conservative branch of Polish politics. The key persons were the twin brothers Jaroslaw and Lech Kaczyński, who were familiar to the public from the revolution and later in different political positions. Lech Kaczyński was minister of justice in the previous government (as a member of the AWS party). Most PiS issues were influenced by the activity of the Kaczyński twins. They were publicly known thanks to their very strong anticommunist opinions and their moral emphasis on social matters. As a result of his ministerial role, Lech Kaczyński attained an image of the hard and uncompromising fighter against violence and any kind of disorder in Poland. From the outset, the party’s emphasis on law and justice was, due to its election success in the 2001 election, had a major influence on all issues associated with Polish politics. This fundamental focus remained unchanged: a deep-rooted anticommunism, a focus on Christianity and morality, a social focus on policies, the call for a strong Poland in Europe, the need for special relations with the USA and close attention to Russian activities. Of significance is the  party’s  attitude  to European integration. Due to the strong role of Poland the last integration development deemed to be unsatisfactory. The EU should be constituted on De Gaulle’s concept – the EU as a Europe of nations. The party’s European policy is fundamentally not negative against the EU. PiS supports the common currency but with a couple of exceptions, for example a slower accepting process. During the period of left-liberal government PiS obtained a boost in popularity. Due to corruption and the ideological discrediting of the left, PiS gained a strong argument for justifying both its moral revolution and its call for the “new beginning”. In the 2005 election PiS gained the best voting result ever (27 %) and forged a coalition with two controversial smaller parties: Self-Defense and League of Polish Families.

The  party  defines  the  position  of  Poland  in  Europe  as  a  strong state with deep roots in history. Very evident is the party’s negative position towards Russia, as a result of historical experience – the three times division of Poland, the occupation during the Second World War and the following communist era. Other foreign relations are o then influenced by these experiences. This is the reason for a strong emphasis on national sovereignty and the prominent role of Poland in Europe. The definition can be found in the country’s Christian heritage, the emphasis on national security, responsibility for  the  nation,  the  strong  role  of  families,  patriotism,  and  also  the EU as a part of the national identity. The party calls for confident delimitation to the strong European states.  Nevertheless, the party opposes any kind of aggressive nationalism that could be harmful for Poland. Generally, for PiS European integration is a positive way in which to cooperate between nation states and for ensuring the strong role of the EU in world politics. On the negative side, the party specifies the current discourse related to European integration. The EU is defined as a social project that rejects the sovereignty of the member states. It goes on, stating that the present state of the EU is more satisfactory for big member states. The party rejected the Treaty on European Union and also the Lisbon Treaty. Poland’s entry in to the monetary union should be made carefully and more in the long term, though timings are not specified in the manifesto.

The most significant manifesto feature is the detailed, elaborate European policy and the strengthening of trans-atlantic ties. Surprisingly, the manifesto more strongly considers the question of the German minority in Poland and bilateral relations generally. This is surprising as this issue was not discussed in the previous manifesto. The European policy started to be more supportive on practical issues. PiS emphasize the need for more transparency in the EU as well as the equality principle for CAP. In a more fundamental way, the manifesto shifted to more pragmatic expressions. The party calls for broader use of the subsidiarity principle (similar to German conservatives), the modernizing of the functional structure of the EU, and a more positive attitude to the completion of the internal market. Yet still, the party recognizes the hegemony of the big member states.  This is the kind of awareness resulting from deeper integration. In general PiS supports European integration and the further enlargement of the zone of stability and peace. The party’s core beliefs refer to an emphasis on creating a confident Polish nation. Primarily PiS calls for the strengthening of national identity, Christian grounds and a high level of morality in the public sphere.  Not long after the party’s founding,  PiS  placed  strong  emphasis on reclaiming ethics and morality after the post-communist period. A highly significant point is also the emphasis on national culture, language and historical heritage.  The party tries to define Poland’s position in European politics between the two great power states Germany and Russia.
